    State Responsibility and Investor-State Dispute Settlement – Hybrid Programme

     

    The State Responsibility and Investor–State Dispute Settlement Workshop will take place on 13 November 2026 at Nishimura & Asahi (Gaikokuho Kyodo Jigyo) in Tokyo.

    The workshop will begin with the general principles of State responsibility under international law, including attribution, breach, circumstances precluding wrongfulness, causation and reparation. It will then examine how these principles operate in the specific context of investor–State arbitration and shape the presentation, defence and resolution of investment treaty claims.

    The workshop will be particularly useful for government officials, State counsel, legal advisers and practitioners involved in disputes concerning State responsibility, as well as academics, researchers and others seeking to deepen their understanding of this area of international law and its practical application in investor–State proceedings.

    By the end of the workshop, participants will be better able to:

    • explain the structure and core principles of the international law of State responsibility;

    • identify when conduct is attributable to a State and when an internationally wrongful act arises;

    • assess questions of causation, injury and the appropriate forms of reparation;

    • understand the relationship between customary rules of State responsibility and investment treaty obligations;

    • analyse how tribunals apply these principles in investor–State disputes; and

    • apply the relevant rules when developing, presenting or defending investment claims.

    The hybrid event will bring together leading experts to discuss current developments in Japan, Asia and the wider ISDS landscape, followed by an audience Q&A and networking reception.
