The contemporary public international law of compensation is addressed in a rich body of decisions by inter-State courts and tribunals as well as bodies considering claims brought by individuals and other non-State entities, including investor-State arbitration tribunals. In 2025, the United Nations International Law Commission included the topic ‘compensation for the damage caused by internationally wrongful acts’ in its current programme of work.

The keynote will reflect on the key legal and practical issues relevant for international dispute settlement that have been identified in the first report on this topic, to be discussed in the 2026 session of the International Law Commission.

Professor Martins Paparinskis is Professor of Public International Law at UCL. He is a member of the United Nations International Law Commission and its Special Rapporteur on compensation for the damage caused by internationally wrongful acts, and has been its Chairperson. He is also an associate member of the Institute of International Law, a member of the Permanent Court of Arbitration, a member of the Board of the OSCE Court of Conciliation and Arbitration, and a member of the ICSID Panel of Arbitrators.
